وبالإضافة إلى المحظورات الأخرى المنصوص عليها في شروط الخدمة، يحظر عليك استخدام الموقع أو محتواه: (أ) لأي غرض غير مشروع؛ (ب) التماس الآخرين للقيام بأي أعمال غير مشروعة أو المشاركة فيها؛ (ج) انتهاك أي أنظمة أو قواعد أو قوانين أو لوائح محلية دولية أو اتحادية أو إقليمية أو ولائية؛ (د) التعدي على حقوق الملكية الفكرية أو حقوق الملكية الفكرية للغير أو انتهاكها؛ (هـ) التحرش أو الإساءة أو الإهانة أو الأذى أو التشهير أو القذف أو التفاوت أو التخويف أو التمييز على أساس نوع الجنس أو الميل الجنسي أو الدين أو العرق أو العمر أو الأصل الوطني أو الإعاقة؛ (و) تقديم معلومات خاطئة أو مضللة؛ (ز) تحميل أو نقل الفيروسات أو أي نوع آخر من الرموز الخبيثة التي ستستخدم أو يمكن أن تستخدم بأي طريقة تؤثر على عمل أو تشغيل الخدمة أو أي موقع إلكتروني ذي صلة، أو غيرها من المواقع الإلكترونية أو الإنترنت؛ (ح) جمع أو تتبع المعلومات الشخصية للآخرين؛ (ط) الرسائل العشوائية أو الاحتيالية أو التجسس أو الزحف أو الكشط؛ (ي) لأي غرض فاحش أو غير أخلاقي؛ أو (ك) التدخل أو التحايل على السمات الأمنية للخدمة أو أي موقع إلكتروني ذي صلة أو مواقع إلكترونية أخرى أو الإنترنت. ونحن نحتفظ بالحق في إنهاء استخدامكم للخدمة أو لأي موقع إلكتروني ذي صلة لانتهاك أي استخدام محظور.
القسم 15 – التنصل من الضمانات وتحديد المسؤولية
ولا نضمن أو نمثل أو نؤذن بأن استخدامكم لموقعنا أو خدمتنا سيكون بلا انقطاع أو في الوقت المناسب أو آمنًا أو خاليًا من الأخطاء.

أنتَ توافق صراحة على أن استخدامك للخدمة أو عدم قدرتك على استخدامها هو مخاطرة لك وحدك. والخدمة وجميع المنتجات والخدمات المقدمة إليكم عن طريقها هي: (باستثناء ما ذكرناه صراحة) متاح "كما هو" لاستخدامكم، دون أي تمثيل أو ضمانات أو شروط من أي نوع، سواء كانت صريحة أو ضمنية، بما في ذلك جميع الضمانات أو الشروط الضمنية لقابلية التجارة والنوعية القابلة للتداول والملاءمة لغرض معين والقدرة على الاستمرار والملكية وعدم التعدي.ولن تتحمل ثيرينوس (ش.م.ح)أو مديرينا أو مسؤولينا أو موظفينا أو الشركات التابعة أو الوكلاء أو المقاولون أو المتدربين الداخليين أو الموردين أو مقدمي الخدمات أو المرخص لهم مسؤولين عن أي ضرر أو خسارة أو مطالبة أو أي أضرار مباشرة أو غير مباشرة أو عرضية أو عقابية أو خاصة أو تبعية من أي نوع، بما في ذلك، دون تحديد الكسب الفائت والدخل الفائت والمدخرات المفقودة وفقدان البيانات وتكاليف الاستبدال أو أي أضرار مماثلة، سواء كانت مستندة إلى عقد أو تعويضات (بما في ذلك الإهمال) أو المسؤولية المشددة أو خلاف ذلك، الناشئة عن استخدامك لأي من الخدمات أو أي منتجات تم شراؤها باستخدام الخدمة أو عن أي مطالبة أخرى تتصل بأي شكل من الأشكال باستخدامك للخدمة أو أي منتج، بما في ذلك، على سبيل المثال لا الحصر، أي أخطاء أو حالات السهو في أي محتوى أو أي خسارة أو ضرر من أي نوع تم تكبده نتيجة لاستخدام الخدمة أو أي محتوى (أو المنتج) المنشورة أو المرسلة أو المتاحة بطريقة أخرى عن طريق الخدمة، حتى لو أُبلغت بإمكانية ذلك. ونظرًا لأن بعض الدول أو الولايات القضائية لا تسمح باستبعاد أو تحديد المسؤولية عن الأضرار التبعية أو العرضية، في تلك الدول أو الولايات القضائية، فإن مسؤوليتنا تكون محدودة إلى أقصى حد يسمح به القانون.
الفرع 16 – التعويضات
أنتَ توافق على التعويض والدفاع وإبراء ذمة ثيرينوس (ش.م.ح) والشركات الأموال والشركات الفرعية والشركات التابعة والشركاء والموظفون والمديرون والوكلاء والمقاولون والمرخصون ومقدمو الخدمات والمتعاقدين من الباطن والموردين والمتدربين والموظفين، من وضد أي مطالبة أو أضرار وتكاليف ونفقات، بما في ذلك الرسوم القانونية، التي يقدمها أي طرف ثالث بسبب أو نتيجة إخلالكم بشروط الخدمة هذه أو الوثائق التي تضمنها بالإشارة أو انتهاككم لأي قانون أو حقوق طرف ثالث أو أي حكم آخر من أحكام الموقع الإلكتروني، بما في ذلك استخدام أطراف ثالثة للوصول إلى الموقع الإلكتروني باستخدام حسابك الناجم عن تصرفاتك أو تقاعسك عن العمل.
القسم 17 – إمكانية الفصل
وفي حال تبين أن أي حكم من شروط الخدمة هذه غير قانوني، يكون هذا الحكم باطلًا أو غير قابل للإنفاذ إلى أقصى حد يسمح به القانون المنطبق، ويعتبر الجزء غير القابل للإنفاذ منفصلًا عن شروط الخدمة هذه ولا يؤثر هذا القرار على صحة أي أحكام أخرى متبقية وقابليتها للإنفاذ.
القسم 18 – الإنهاء
تظل التزامات ومسؤوليات الأطراف المتكبدة قبل تاريخ الإنهاء سارية بعد إنهاء هذه الاتفاقية لجميع الأغراض.
شروط الخدمة الماثلة نافذة ما لم يتم إنهاؤها من قبلك أو من قبلنا. يمكنك إنهاء هذه الشروط من الخدمة في أي وقت من خلال إخطارنا أنك لم تعد ترغب في استخدام خدماتنا أو عندما تتوقف عن استخدام موقعنا. وفي حال عدم امتثالك في تقديرنا أو راودنا الشك في عدم امتثالك لأي شرط أو حكم من شروط الخدمة الماثلة، يجوز لنا كذلك الاتفاقية الماثلة في أي وقت دون إشعار، وستظل مسؤولًا عن جميع المبالغ المستحقة حتى تاريخ الإنهاء؛ و/أو بالتالي يجوز لنا منعك من الوصول إلى خدماتنا (أو أي جزء منها).
القسم 19 – مجمل الاتفاق
لا يشكل عدم ممارستنا أو إنفاذأي حق أو حكم من شروط الخدمة الماثلة تنازلًا عن هذا الحق أو الحكم.
تشكل شروط الخدمة الماثلة وأي سياسات أو قواعد تشغيل منشورة من قبلنا على موقعنا أو فيما يتعلق بالخدمة مجمل الاتفاق والتفاهم بينك وبيننا وتحكم استخدامك للخدمة، وتحل محل أي اتفاقيات ومراسلات ومقترحات سابقة أو معاصرة، سواء كانت شفهية أو كتابية، بينك وبيننا (بما في ذلك على سبيل المثال لا الحصر أي إصدارات سابقة من شروط الخدمة).
ولا يجوز تفسير أي غموض في شروط الخدمة الماثلة ضد الجهة التي تصيغها.
القسم 20 – القانون الحاكم
تخضع شروط الخدمة وأية سياسات أو قواعد تشغيل منشورة من قبلنا على موقعنا أو أي اتفاقيات منفصلة نقدم بموجبها الخدمات لك وتفسر وفقًا للقوانين الاتحادية لدولة الإمارات العربية المتحدة وقوانين إمارة دبي،وتخضع جميع النزاعات الناشئة هنا للاختصاص القضائي الحصري لمحاكم دبي بدولة الإمارات العربية المتحدة.
